(hereinafter, “UGROUND”), in compliance with the regulations in force, particularly Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (General Data Protection Regulation — GDPR), and Organic Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

The purpose of this policy is to help the User make informed decisions when using the Website and to understand how we handle the personal information provided through emails sent to the addresses indicated on the Website. We invite you to read it carefully so that you can always maintain control over your personal data.

The User guarantees that the data provided is true, accurate, complete, and up to date, and is responsible for any damage or harm, direct or indirect, that may arise as a result of non-compliance with this obligation. In the event that the data provided belongs to a third party, the User guarantees that they have informed said third party of the terms of this Privacy Policy and have obtained their prior authorization to provide their data to UGROUND for the stated purposes.

2. Purpose

At UGROUND, we process the information provided by interested parties for the following purposes:

  • To manage and control our customer portfolio.

  • To maintain client relationships for billing and payment purposes.

  • To manage the delivery of requested information.

  • To offer interested parties products, services, upcoming events, or relevant news that may be of interest.

  • To evaluate and manage submitted résumés for recruitment processes that match a candidate’s professional profile and to carry out the necessary steps for hiring personnel.

Failure to accept this purpose will mean we cannot inform you about our news and events.

UGROUND is committed to maintaining the confidentiality of personal data and to taking the necessary technical and organizational measures to ensure an appropriate level of security according to the data processed. We have mechanisms in place to prevent, as far as possible, unauthorized access, theft, unlawful modifications, and loss of data, always taking into account the state of technology and in compliance with applicable legislation. UGROUND is not responsible for unlawful thefts, modifications, or losses of data.

The User is solely responsible for the accuracy and correctness of the data provided to UGROUND, which accepts no responsibility for inaccuracies or errors in the data.

Data Retention

  • Customer and billing data: kept as long as the contract is in force and, once ended, for as long as required by applicable law and until any potential liabilities arising from the contract expire.

  • Marketing communications: retained indefinitely until the user requests their deletion.

  • Curriculum vitae (résumés): kept for 12 months.

We will not retain your personal data longer than necessary and only as long as required for the purpose for which it was collected. We may, however, keep certain information as required by law or for as long as reasonably necessary to comply with legal obligations, resolve disputes, prevent fraud and abuse, or enforce our terms and conditions.

3. Legitimacy

The legal basis for processing your data is the execution of the relevant service agreement.

The legitimate interest of UGROUND forms the legal basis for the prospective offer of products and services to existing clients, as recognized by the GDPR, which expressly allows personal data processing for direct marketing purposes.

The legal basis for sending marketing communications to non-clients is the user’s consent, which may be withdrawn at any time. Withdrawal of consent will not affect the lawfulness of prior processing carried out before its withdrawal.

You have the right to object to this data processing at any time, by any of the means described in this Policy.

The legal basis for processing résumés is the consent provided by the candidate when submitting their résumé for recruitment purposes.

4. Data Recipients

Data may be communicated to the following entities:

  • Financial institutions involved in payment and collection management.

  • Competent public authorities, in cases required by law and for purposes defined therein.

5. International Data Transfers

No international data transfers are carried out.

6. Automated Decisions

No automated decisions or commercial profiling will be made based on the information provided.

7. Data Source

We inform you that we only collect data directly from you; we do not obtain data from third-party sources.

8. Rights

  • Anyone has the right to obtain confirmation as to whether UGROUND is processing personal data concerning them, and access the following information: purposes of processing; categories of data processed; recipients or categories of recipients to whom data has been or will be disclosed; the expected retention period or the criteria used to determine it.

    Data subjects have the right to access their personal data, request rectification of inaccurate data, or request deletion of data when, among other reasons, it is no longer necessary for the purposes for which it was collected.

    You may also request the deletion of your personal data in the following cases:

    • It is no longer needed for the purposes for which it was collected.

    • You withdraw consent and there is no other legal basis for processing.

    • You object to the processing and no legitimate grounds prevail.

    • The data has been processed unlawfully.

    In certain circumstances, you may request the restriction of processing, in which case data will only be retained for exercising or defending legal claims.

    In certain situations and for reasons related to your specific circumstances, you may object to data processing. UGROUND will stop processing data unless compelling legitimate grounds exist or for the exercise or defense of potential legal claims.

    Data subjects also have the right to data portability, meaning that your personal data may be transmitted directly from one controller to another, where technically feasible, without you having to handle it.
